Terms of Use

These Terms of Use (“Terms”) govern your access to and use of MyHomeFirstCall.com (the “Site”) and the information, features, connection services, and other functionality made available through the Site.

Please read these Terms carefully. They contain important provisions affecting your legal rights, including provisions concerning independent service providers, releases of certain claims, limitations of liability, indemnification, binding individual arbitration, waiver of jury trial, and waiver of class and representative actions.

By accessing or using the Site, you agree to these Terms to the extent permitted by applicable law. Where a particular Site feature requires a separate affirmative acceptance of these Terms or another agreement, the terms presented with that feature will also apply.

If you do not agree to these Terms, please do not use the Site.

MyHomeFirstCall is a connection and referral service. MyHomeFirstCall does not perform plumbing services and is not the plumbing contractor that performs work at your property. Plumbing and other home services are provided by independent third-party service providers.

1. About MyHomeFirstCall

MyHomeFirstCall provides homeowners with information about common plumbing and home-service problems and may provide ways for homeowners to seek a connection with an independent service provider serving their area.

The Site is intended to make it easier to understand common service problems and seek professional assistance when appropriate. MyHomeFirstCall does not itself diagnose, inspect, repair, install, replace, maintain, or otherwise perform plumbing or other home-service work.

2. Connection and Referral Service

If you use a feature of the Site to seek plumbing or other home-service assistance, MyHomeFirstCall may attempt to facilitate a connection with an independent service provider directly or through a service-network, referral, telecommunications, lead-routing, or technology partner.

A connection may depend on factors such as your location, the type of service requested, provider availability, network participation, operating hours, routing technology, and other circumstances.

Submitting a request, placing a call through the Site, or otherwise using a connection feature does not guarantee that a service provider will be available, accept the request, contact you, provide an estimate, schedule an appointment, or perform services.

3. Independent Service Providers

Service providers reached through or in connection with the Site are independent third parties. Except where expressly stated otherwise, they are not employees, agents, representatives, joint venturers, or contractors of MyHomeFirstCall, and MyHomeFirstCall does not employ them to perform plumbing work for you.

The independent service provider is responsible for evaluating conditions at the property, diagnosing the problem, determining what work may be appropriate, discussing available options with you, establishing pricing and payment terms, providing estimates where applicable, scheduling service, obtaining permits where required, supplying labor and materials, performing the work, addressing warranties, and responding to workmanship or service issues.

Your decision to hire, retain, authorize, or pay a service provider creates a separate relationship between you and that provider. MyHomeFirstCall is not a party to the contract for plumbing or other home-service work unless MyHomeFirstCall expressly agrees otherwise in a separate written agreement.

4. No Endorsement or Guarantee of Providers

A provider’s availability through a connection facilitated by MyHomeFirstCall does not constitute a representation that the provider is the best, lowest-priced, closest, highest-rated, or only provider available to you.

Unless expressly stated otherwise, MyHomeFirstCall does not independently endorse, certify, warrant, or guarantee a particular provider or the provider’s services.

You remain responsible for deciding whether to engage a provider and may seek additional information, estimates, references, or providers before making that decision.

5. Provider Qualifications, Licensing, and Insurance

Independent service providers are responsible for maintaining any licenses, registrations, permits, insurance, qualifications, and other credentials required for the services they offer under applicable law.

MyHomeFirstCall does not perform the provider’s work and does not independently guarantee a provider’s licensing status, insurance coverage, qualifications, legal compliance, availability, or workmanship.

You may independently verify licensing, insurance, qualifications, warranties, and other information that is important to your decision before authorizing work.

6. Provider Availability and Routing

MyHomeFirstCall does not guarantee that a particular provider will be available in your geographic area or at a particular time.

Depending on the connection system in use, a request may be routed directly or through a service network or technology platform based on factors that may include location, requested service, network coverage, provider availability, operating hours, network participation, routing rules, capacity, and commercial relationships.

The provider or network that receives a request may change depending on those circumstances.

7. Pricing, Estimates, Contracts, and Payment

MyHomeFirstCall does not set the prices charged by independent service providers for plumbing or other home services.

Any estimate, service price, diagnostic charge, trip charge, financing arrangement, deposit, payment obligation, cancellation term, warranty, or other financial or contractual condition relating to the actual service should be reviewed directly with the independent provider.

Unless expressly stated otherwise in connection with a specific offering, payments for plumbing or home-service work are made to and handled by the independent provider rather than MyHomeFirstCall.

You are responsible for reviewing and agreeing to the provider’s service terms before authorizing work.

8. Referral Relationships and Compensation

MyHomeFirstCall may have commercial relationships with independent service providers, service networks, referral partners, lead platforms, telecommunications providers, technology companies, or other businesses involved in connecting consumers with service providers.

MyHomeFirstCall may receive compensation in connection with calls, leads, referrals, introductions, or other connections generated through the Site. Depending on the applicable arrangement, compensation may be based on whether a call or request satisfies qualification or acceptance criteria and may not depend on whether you ultimately hire the provider.

Commercial relationships, along with factors such as location, service type, availability, routing, and network participation, may affect which provider or network receives a request.

You are not required to hire a provider merely because you were connected through MyHomeFirstCall.

9. Information and Educational Content

The Site may provide general information about plumbing problems, warning signs, possible causes, common next steps, and circumstances in which professional assistance may be appropriate.

This information is provided for general informational purposes and is not a substitute for an on-site inspection, professional diagnosis, individualized advice, or professional judgment from a qualified person who can evaluate the actual conditions at your property.

Plumbing and property conditions can differ substantially. Information that may be appropriate in one situation may not be appropriate in another.

10. Emergency and Safety Limitations

Some plumbing or home-service problems may involve risks to property, health, or personal safety. Information on the Site does not replace emergency services, utility instructions, governmental safety guidance, or professional evaluation when those resources are appropriate.

If you believe there is an immediate threat to life or personal safety, contact the appropriate emergency service. If a situation involves electricity, gas, fire, contaminated water, structural hazards, flooding, or another potentially dangerous condition, avoid actions that may expose you or others to unnecessary risk and seek appropriate professional assistance.

MyHomeFirstCall does not guarantee emergency response or provider arrival within any particular period.

11. Information You Provide

When you provide information through the Site, you represent that the information is reasonably accurate, that you are authorized to provide it, and that your use of the Site does not violate another person’s rights.

You may not knowingly submit false, deceptive, fraudulent, unlawful, or unauthorized information, impersonate another person, submit service requests for property without appropriate authority, or misuse another person’s contact information.

You are responsible for consequences arising from information or instructions you knowingly provide through the Site.

12. Communications

If you contact MyHomeFirstCall or initiate a service connection, MyHomeFirstCall may communicate with you concerning the inquiry, request, or relationship you initiated.

If your request is provided to an independent service provider, service network, or referral partner, that party may contact you concerning the requested service.

Where applicable law requires specific authorization for automated calls, prerecorded messages, text messages, or other communications, any required authorization will be presented separately at the appropriate point of collection.

Use of the Site or acceptance of these Terms by itself does not constitute consent to receive automated marketing calls or text messages where separate consent is required by law.

13. Call Routing, Monitoring, and Recording

Telephone numbers displayed through the Site may, depending on the technology and operating arrangement in use, utilize call-routing, tracking, telecommunications, attribution, or service-network technology.

Calls may be monitored or recorded if the applicable system and operating arrangement provide for it. Where monitoring or recording occurs, notice and any consent required by applicable law will be provided through the applicable call process or another appropriate mechanism.

These Terms by themselves do not constitute consent to call recording where additional notice or consent is required by law.

14. Privacy

Information collected through the Site is handled as described in the MyHomeFirstCall Privacy Policy.

The Privacy Policy explains the types of information that may be collected, how information may be used or disclosed, and other practices relating to personal information.

Additional privacy notices or permissions may be presented in connection with particular features where appropriate or required.

15. Acceptable Use

You may use the Site only for lawful purposes and in accordance with these Terms.

You may not intentionally interfere with the operation, availability, integrity, or security of the Site; attempt to gain unauthorized access to systems, accounts, data, or networks; introduce viruses, malware, harmful code, or other disruptive technology; scrape, harvest, probe, reverse engineer, or systematically extract Site information except as permitted by law; submit fraudulent or abusive requests; impersonate another person or organization; interfere with another user’s use of the Site; use the Site to violate applicable law; or use the Site in a manner that infringes or misappropriates another person’s rights.

We may restrict, suspend, or terminate access when reasonably necessary to protect the Site, users, providers, partners, or our operations.

16. Intellectual Property

The Site and its original content, branding, logos, design elements, graphics, text, organization, and other materials provided by MyHomeFirstCall are owned by or licensed to MyHomeFirstCall and are protected by applicable intellectual-property laws.

You may use the Site for personal, lawful, noncommercial purposes related to obtaining information or seeking home-service assistance.

Except as permitted by law or expressly authorized by MyHomeFirstCall, you may not reproduce, distribute, modify, publicly display, commercially exploit, or create derivative works from protected MyHomeFirstCall materials.

Nothing in these Terms transfers ownership of any MyHomeFirstCall intellectual property to you.

17. Third-Party Websites, Networks, and Technology

The Site may link to, integrate with, or rely upon websites, platforms, telecommunications systems, referral networks, analytics systems, service networks, or other technologies operated by third parties.

MyHomeFirstCall does not control those third-party systems merely because they are linked to or used in connection with the Site.

Third parties are responsible for their own websites, services, security, availability, content, terms, and privacy practices. Your interaction with a third-party service may be governed by separate terms or policies.

18. Disputes With Independent Service Providers

Any agreement for plumbing or other home-service work is ordinarily between you and the independent provider.

Questions, complaints, claims, warranty issues, property-damage allegations, billing disputes, workmanship disputes, scheduling problems, or other matters arising from the provider’s actual services should ordinarily be addressed directly with that provider.

MyHomeFirstCall may, in its discretion, provide information or reasonable assistance intended to facilitate communication, but MyHomeFirstCall is not obligated to mediate, adjudicate, resolve, or pay claims arising between you and an independent provider.

19. Release Concerning Independent Providers

To the fullest extent permitted by applicable law, you acknowledge that independent service providers are separate third parties and agree that MyHomeFirstCall and its owners, officers, directors, employees, agents, affiliates, successors, and assigns are not responsible merely by reason of facilitating a connection for the acts, omissions, statements, pricing, recommendations, estimates, services, workmanship, delays, property damage, injuries, warranty obligations, contractual breaches, or other conduct of an independent service provider.

To the fullest extent permitted by law, you release MyHomeFirstCall and those protected parties from claims arising solely from the independent acts or omissions of a service provider or from a dispute between you and that provider.

This release does not waive any claim to the extent applicable law prohibits the claim from being waived or to the extent a claim arises from conduct for which MyHomeFirstCall itself is legally responsible and liability cannot lawfully be excluded.

20. No Guarantee of Service Results

MyHomeFirstCall may facilitate a connection but does not control an independent provider’s diagnosis, recommendations, pricing, scheduling, staffing, availability, materials, workmanship, warranties, communications, or results.

MyHomeFirstCall does not guarantee that a connection will result in an appointment, completed service, successful repair, particular price, particular provider, particular response time, or resolution of a plumbing or home-service problem.

21. Site Availability and Changes

The Site and its features may change over time. We may modify, suspend, restrict, replace, or discontinue all or part of the Site or a particular feature.

We do not warrant that the Site, a telephone number, connection service, provider network, or other functionality will always be available, uninterrupted, secure, error-free, or compatible with every device.

Maintenance, network failures, telecommunications conditions, third-party systems, provider availability, security events, and other circumstances may affect operation of the Site.

22. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, ITS CONTENT, AND CONNECTION FEATURES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

MYHOMEFIRSTCALL DISCLAIMS WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

MYHOMEFIRSTCALL DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT INFORMATION WILL ALWAYS BE COMPLETE OR ACCURATE, THAT A SERVICE PROVIDER WILL BE AVAILABLE, THAT A PROVIDER WILL MEET YOUR EXPECTATIONS, OR THAT SERVICES PERFORMED BY AN INDEPENDENT PROVIDER WILL ACHIEVE ANY PARTICULAR RESULT.

Nothing in these Terms excludes a warranty or right that applicable law does not permit the parties to exclude.

23. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYHOMEFIRSTCALL AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITY; OR SIMILAR LOSSES ARISING OUT OF OR RELATING TO THE SITE, A CONNECTION, AN INDEPENDENT PROVIDER, OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES MAY BE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, MYHOMEFIRSTCALL’S AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THESE TERMS, OR A CONNECTION FACILITATED THROUGH THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID DIRECTLY TO MYHOMEFIRSTCALL FOR THE PARTICULAR CONSUMER SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

The limitations in this section apply regardless of the legal theory asserted, including contract, tort, negligence, statutory claim, or otherwise, to the extent permitted by law.

These limitations do not apply to liability that cannot lawfully be excluded or limited.

24. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless MyHomeFirstCall and its owners, officers, directors, employees, agents, affiliates, successors, assigns, and, where applicable to their role in operating or supporting the Site or connection service, its technology providers, telecommunications providers, referral partners, and service-network partners, from and against third-party claims, demands, actions, proceedings, liabilities, judgments, settlements, penalties, fines, losses, damages, costs, and expenses, including reasonable attorneys’ fees and defense costs, arising out of or relating to your violation of these Terms, misuse of the Site, unlawful activity, fraudulent or unauthorized service requests, false or materially inaccurate information supplied by you, violation of another person’s privacy, intellectual-property, property, contractual, or other legal rights, or acts or omissions by you that cause injury or loss to another person.

Your indemnification obligations also apply to third-party claims resulting from content, instructions, representations, contact information, property information, or other material you submit or cause to be submitted through the Site where the claim results from your conduct or your lack of authority to provide that information.

MyHomeFirstCall may, at its election and at your expense where permitted by law, assume exclusive control of the defense of a matter subject to indemnification. You agree to provide reasonable cooperation in connection with the defense.

You may not settle a matter subject to indemnification in a way that imposes liability, obligations, admissions, restrictions, or other prejudice on a protected MyHomeFirstCall party without that party’s prior written consent.

This section does not require you to indemnify MyHomeFirstCall for liability to the extent caused by MyHomeFirstCall’s own conduct where applicable law prohibits such indemnification.

25. Insurance, Subrogation, and Derived Claims

To the fullest extent permitted by applicable law, a person or entity asserting rights derived solely through you, including an insurer, subrogee, assignee, or similar successor to your claim, acquires no greater rights against MyHomeFirstCall than you possessed under these Terms.

Any applicable release, disclaimer, limitation of liability, arbitration requirement, class-action waiver, or other defense that would apply to a claim asserted directly by you will also apply to a derivative claim to the extent permitted by law.

Nothing in this section limits rights that cannot lawfully be waived or restricted.

26. Informal Dispute Resolution

Before filing an arbitration or court proceeding concerning a dispute with MyHomeFirstCall, you and MyHomeFirstCall agree to make a reasonable good-faith effort to resolve the dispute informally, except where immediate provisional relief is reasonably necessary or applicable law does not permit such a requirement.

A party initiating a dispute should provide enough information to identify the issue, the relevant facts, and the requested resolution.

If the dispute has not been resolved within thirty days after adequate written notice is received, either party may proceed with arbitration or another proceeding expressly permitted under these Terms.

27. Binding Individual Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

To the fullest extent permitted by applicable law, you and MyHomeFirstCall agree that any dispute, claim, or controversy arising out of or relating to the Site, these Terms, your use of a connection service, communications with MyHomeFirstCall, or the relationship between you and MyHomeFirstCall that cannot be resolved through informal dispute resolution will be resolved through final and binding arbitration on an individual basis rather than through a lawsuit before a judge or jury.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement to the extent applicable because use of the Site and connection services may involve interstate commerce.

The arbitration agreement is intended to be interpreted broadly and applies to claims based in contract, tort, statute, fraud, misrepresentation, negligence, or another legal theory, including claims arising before termination of your use of the Site and claims concerning prior versions of these Terms to the extent legally enforceable.

Unless the parties agree otherwise, arbitration will be administered by the American Arbitration Association under the applicable Consumer Arbitration Rules then in effect. If the American Arbitration Association is unable or unwilling to administer the arbitration, a court of competent jurisdiction may select another neutral arbitration administrator consistent with this section.

The arbitrator may award the same individual remedies that would otherwise be available in court to the extent authorized by applicable law, but may not award relief for or against persons who are not parties to the arbitration except where applicable law requires otherwise.

The arbitrator will have authority to resolve disputes concerning the interpretation, applicability, scope, or enforceability of this arbitration agreement, except that a court of competent jurisdiction will determine disputes concerning the existence of an agreement to arbitrate and the enforceability of the Class and Representative Action Waiver to the extent applicable law requires those questions to be decided by a court.

If a dispute includes both claims that are subject to arbitration and claims that are not subject to arbitration, the parties agree that, to the fullest extent permitted by applicable law, the non-arbitrable claims will be stayed until the arbitration of the arbitrable claims has been completed.

This arbitration provision survives termination of these Terms and your relationship with MyHomeFirstCall.

28. Limited Exceptions to Arbitration

Notwithstanding the arbitration agreement above, either party may bring an individual claim in small claims court if the claim qualifies for that court’s jurisdiction and remains there solely on an individual basis.

Either party may seek temporary, preliminary, or other provisional injunctive relief from a court of competent jurisdiction where reasonably necessary to protect intellectual-property rights or to preserve the status quo while an arbitrable dispute is pending. Seeking such provisional relief does not waive or otherwise affect the parties’ obligation to arbitrate the underlying dispute.

A claim that applicable federal law or another governing law not preempted by the Federal Arbitration Act expressly prohibits from being resolved through mandatory arbitration is excluded only to the extent required by that law.

Except for these limited circumstances, disputes covered by the arbitration agreement must be resolved through binding individual arbitration.

29. Waiver of Jury Trial

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND MYHOMEFIRSTCALL KNOWINGLY WAIVE THE RIGHT TO HAVE A DISPUTE COVERED BY THE ARBITRATION AGREEMENT DECIDED BY A JUDGE OR JURY IN COURT.

For any claim that lawfully proceeds in court rather than arbitration, each party waives trial by jury to the fullest extent permitted by applicable law.

30. Class and Representative Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MYHOMEFIRSTCALL AGREE THAT CLAIMS MAY BE BROUGHT AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY.

Neither you nor MyHomeFirstCall may bring, participate in, or seek relief through a purported class action, collective action, consolidated action, private attorney-general action, or representative proceeding on behalf of other persons where such waiver is permitted by law.

An arbitrator may not combine or consolidate the claims of more than one person or preside over a class, collective, or representative proceeding unless the parties expressly agree or applicable law requires otherwise.

If a final decision by a court of competent jurisdiction determines that a particular portion of this waiver is unenforceable as to a particular claim or form of relief, that portion will be severed and may proceed as required by law, while the remaining arbitrable claims will continue on an individual basis to the fullest extent legally permitted.

31. Governing Law

Except for the arbitration agreement, which is governed by the Federal Arbitration Act to the extent applicable, these Terms and disputes arising from them are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent another law must apply and cannot lawfully be waived.

Nothing in this section deprives a consumer of a non-waivable protection provided by applicable law.

32. Venue for Non-Arbitrable Claims

For a dispute that is not subject to arbitration and may lawfully be subject to an agreed venue, you and MyHomeFirstCall consent to exclusive jurisdiction in the appropriate state or federal courts located in the Florida county in which MyHomeFirstCall maintains its principal place of business at the time the proceeding is commenced.

This venue provision does not apply where applicable law requires a different forum or does not permit the parties to select the forum in advance.

33. Assignment

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of MyHomeFirstCall, except where applicable law provides otherwise.

MyHomeFirstCall may assign or transfer these Terms and related rights or obligations in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, change of control, affiliate restructuring, or transfer of the Site or relevant business operations, to the extent permitted by law.

Subject to those limitations, these Terms bind and benefit the parties and their permitted successors and assigns.

34. No Waiver

A failure or delay by MyHomeFirstCall to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

A waiver is effective only to the extent expressly provided and does not constitute a continuing waiver unless expressly stated.

35. Severability

If a provision of these Terms is held invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary, and the remaining provisions will continue in effect.

Where a particular dispute-resolution provision contains a more specific severability rule, that specific rule controls with respect to that provision.

36. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly incorporated into or presented with a particular Site feature, constitute the agreement between you and MyHomeFirstCall concerning your use of the Site and the subject matter addressed by those documents.

They supersede prior or contemporaneous communications or understandings between you and MyHomeFirstCall concerning that subject matter, except for a separate written agreement expressly intended to control.

Your relationship with an independent service provider may be governed by a separate agreement between you and that provider.

37. No Agency or Partnership With Users

Nothing in these Terms creates a partnership, joint venture, employment, fiduciary, franchise, or agency relationship between you and MyHomeFirstCall.

You do not have authority to make commitments, representations, or obligations on behalf of MyHomeFirstCall.

38. Third-Party Beneficiaries

Except as expressly stated in these Terms, these Terms do not create rights in unrelated third parties.

The MyHomeFirstCall owners, officers, directors, employees, agents, affiliates, successors, assigns, and other parties expressly protected by the release, limitation-of-liability, indemnification, arbitration, or related provisions are intended beneficiaries of those provisions to the extent applicable to them and permitted by law.

An independent service provider is not made a beneficiary of a release from responsibility for that provider’s own plumbing or home-service work merely by being connected through the Site.

39. Survival

Provisions that by their nature should continue after termination of your use of the Site will survive, including provisions concerning intellectual property, provider disputes, releases, warranty disclaimers, limitations of liability, indemnification, derived claims, dispute resolution, arbitration, jury and class-action waivers, governing law, assignment, and other provisions necessary to give continuing effect to the parties’ rights and obligations.

40. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Site, business practices, technology, service-provider or network relationships, legal or regulatory requirements, or other operational circumstances.

When these Terms are updated, the Last Updated date shown below will be revised.

Changes will apply prospectively to the extent required by applicable law. Where additional notice or affirmative agreement is legally required for a material change, MyHomeFirstCall will provide the required notice or obtain the required agreement before relying on that change.
